Walmart shopper says he was injured at store because of snow, ice

HUNTINGTON – An Ohio man alleges he was injured at a Walmart in Huntington because of snow and ice at the store.

Michael Estep filed a complaint Jan. 19 in Cabell Circuit Court against Wal-Mart Stores East LP, et al. alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 22, 2016, he shopping at defendants' store in Huntington near the food department entrance. He alleges it was snowing that day and the defendants permitted snow and ice to accumulate in the store, which caused him to fall.

The plaintiff holds Wal-Mart Stores East LP, et al. responsible because the defendants allegedly negligently allowed the accumulation of snow and failed to provide sufficient warnings of the existing danger.

The plaintiff requests a trial by jury and seeks damages in excess of the minimum jurisdiction of the court, plus interest, costs, attorney's fees and all issues triable by jury. He is represented by Matthew P. Stapleton and Scott G. Stapleton of Stapleton Law Offices in Huntington. The case has been assigned to Circuit Judge Paul T. Farrell.
