CHARLESTON – Two St. Louis, Missouri-based employers are alleged to have failed to pay former employees their wages in a timely manner.
Randy Tomblin filed a complaint individually and on behalf of those similarly situated Jan. 26 in Kanawha Circuit Court against Slay Transportation Co. Inc. and Industrial Marketing Inc. citing the West Virginia Wage Payment and Collection Act.
According to the complaint, the plaintiff was employed by the defendants until November 2015. He alleges that to date, the defendants have not paid his wages in full in violation of the WPCA.
The plaintiff holds Slay Transportation Co. Inc. and Industrial Marketing Inc. responsible because the defendants allegedly failed to pay all wages due to the plaintiff within the time period required by the WPCA.
The plaintiff requests a trial by jury and seeks all damages, compensatory damages, interest and court costs. He is represented by Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston and by Mark A. Toor of Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
