Patient alleges she was sexually assaulted at Herbert J. Thomas Memorial Hospital

Medical malpractice 07

LOGAN – A Logan County woman alleges she was sexually assaulted by a nurse at a hospital.

Beverly Eve Adams filed a complaint Jan. 26 in Logan Circuit Court against Herbert J. Thomas Memorial Hospital Association and John Doe alleging assault and intentional infliction of emotional distress.

According to the complaint, the plaintiff alleges that on Jan. 31, 2016, she was admitted to Herbert J. Thomas Memorial Hospital for further treatment. She alleges during her stay, she was sexually assaulted by Doe, a male nurse. The suit states the plaintiff's sister took her to Logan Regional Medical Center for a forensic examination, where a Logan County Sheriff's Department member was present. The plaintiff alleges she believes a criminal investigation was conducted but she is unaware of the ultimate disposition of it.

The plaintiff holds Herbert J. Thomas Memorial Hospital Association and Doe because defendant Thomas Hospital allegedly negligently failed to provide proper safeguards and procedures to prevent any sexual assault in its facility and Doe's sexual assault was willful and outrageous.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus interest, costs and all other relief that the court may deem just and proper. She is represented by Jason D. Harwood of Harwood Legal PLLC in Logan. The case has been assigned to Circuit Judge Eric H. O'Briant.
