Property owner alleges Columbia Gas misrepresented right of way location

WINFIELD – A Putnam County property owner is suing a gas company, alleging an agreement and temporary access easement are null and legally void.

Melissa Thorner filed a complaint Jan. 29 in Putnam Circuit Court against Columbia Gas Transmission LLC alleging fraud and misrepresentation.

According to the complaint, the plaintiff owns a 70-acre tract of land in Putnam County. The suit says on June 15, 2017, Thorner executed a certain easement and right-of-way agreement to Columbia Gas. She alleges the defendant fraudulently misrepresented the location of the right of way and she was injured by these representations.

Thorner seeks trial by jury, an order declaring the easement and right-of-way agreement are void and legally unenforceable, all damages, court costs and attorney fees, and all relief the court deems proper and just. She is represented by attorney O. Gay Elmore Jr. of Charleston.
