Woman says she was injured in bleachers at Fayetteville High football game

FAYETTEVILLE – A Fayette County woman is suing the county school board after she says she was injured at a Fayetteville High School football game.

Rachel Rene Myers filed her complaint Jan. 16 in Fayette Circuit Court against the Fayette County Board of Education.

In her complaint, Myers says she was attending a football game at the school on Oct. 28, 2016, when she was ready to exit the bleachers.

She says she had to walk down the bleachers instead of the stairs because they were “being blocked by patrons and their belongings, including stadium chairs.”

It was then that Myers said she slipped and fell, receiving injuries to her head, shoulder, chest, left arm, elbow and knee as well as abrasions and contusions.

She says the school board is to blame for her injuries and that the board acted in a negligent, willful, wanton and reckless manner. She says that because of the success of the Fayetteville High football team, the board should have foreseen “that there would be a large crowd at the game and that it would need to take reasonable precautions to prepare for such crowd and to ensure the safety of its patrons attending the football game and who would be entering and exiting the bleachers.” She also says the board should have known the aisles would contain obstructions and failed to restrict items brought into the stadium.

Myers says she also suffered pain and suffering, emotional distress, mental anguish, medical bills and expenses, loss of income, loss of enjoyment of life and other injuries.

She seeks compensatory damages for past and future medical expenses, lost wages, loss of earning capacity and other loss of services. She also seeks general damages, punitive damages, pre- and post-judgment interest, court costs, attorney fees and other relief.

She is being represented by Matthew Bradford of Lusk & Bradford in Beckley.  The case has been assigned to Circuit Judge John W. Hatcher Jr.
