Driver seeks damages from FMRS Health Systems, employee after Beckley collision

BECKLEY – A Maryland resident is seeking damages from a Raleigh County driver after an auto accident in Beckley.

Dhiraj Ranjit filed a complaint Feb. 7 in Raleigh Circuit Court against Marcy Ellen Lester and FMRS Health Systems Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on April 6, 2016, he was driving a motor vehicle on City Avenue in Beckley when defendant Lester, who was in the course and scope with her employment with defendant FMRS, negligently caused the cargo van she was driving to collide with plaintiff's vehicle. He alleges he sustained injuries that caused him to incur medical expenses, pain and suffering, disability, annoyance and lost wages as a result of the collision. 

The plaintiff holds Lester and FMRS Health Systems Inc. responsible because defendant Lester allegedly breached her duty to operate a motor vehicle in a safe and careful manner by failing to yield to the right of way and by not maintaining careful lookout.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus interest, attorney's fees, costs and expenses and such other just and appropriate relief. He is represented by Robert D. Cline, Brian E. Bigelow and Jennifer Dempsey Meeteer of Farmer, Cline & Campbell PLLC in Beckley. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
