Kentucky woman alleges claim for disability benefits was wrongfully denied

HUNTINGTON – A Kentucky resident alleges her claim for disability benefits was illegally denied.

Genka Popov filed a complaint Feb. 12 in U.S. District Court for the Southern District of West Virginia Huntington Division against University Physicians & Surgeons Inc., et al. alleging that the plan administrators violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff was employed by University Physicians & Surgeons Inc. and qualified for disability benefits. The suit states the defendant became disabled in April 2016 and her claim for benefits was denied by the defendants.

The plaintiff holds University Physicians & Surgeons Inc., et al. responsible because the defendants' denial of the plaintiff's claim was allegedly arbitrary, illegal and not made in good faith.

The plaintiff requests a trial by jury and seeks an order for defendants to pay all benefits due to her, plus interest, attorney's fees, costs and all other legal relief that the court may deem proper. She is represented by Mark F. Underwood of Underwood Law Offices in Huntington.
