BECKLEY – A Beckley mother and son are seeking damages from a motorist and insurer regarding an auto accident in Sophia.
Christey Stover and Zackery Carr filed a complaint Feb. 15 in Raleigh Circuit Court against Julian D. Murphy and State Farm Mutual Automobile Insurance Co. alleging breach of contract and other counts.
According to the complaint, on March 18, 2016, Stover and Carr were in a motor vehicle traveling on Route 16 at its intersection with Tank Hill Road in Sophia when Murphy negligently rear-ended their vehicle.
They allege they sustained serious and permanent injuries that required medical attention and treatment as a result of the collision and that the insurance policy held by Murphy was not enough to cover the medical costs for their injuries. The plaintiffs allege State Farm has refused to pay their claims for underinsured motorist coverage.
The plaintiffs seek compensatory and punitive damages, plus interest, attorney's fees, costs and any additional relief that the jury may deem just and proper. They are represented by Benny G. Jones in Beckley. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
