Woman allege she is owed coverage from State Farm for auto accident injuries

NEW CUMBERLAND – A Weirton woman alleges she is entitled to underinsured motorist benefits from an insurance company over injuries she received in an auto accident.

Connie Clark filed a complaint Feb. 16 in Hancock Circuit Court against State Farm Mutual Automobile Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Feb. 14, 2016, she was seriously injured in a motor vehicle accident that was caused by an underinsured motorist. She alleges she carried underinsured coverage from the defendant and submitted a claim in March 2016 and that the defendant has refused to pay underinsured motorist benefits to the plaintiff.

The plaintiff holds State Farm Mutual Automobile Insurance Co. responsible because the defendant allegedly breached the policy by refusing to tender the policy limits.

The plaintiff requests a trial by jury and seeks actual and punitive damages, plus interest, costs, attorney's fees and all further relief that the court may deem just and proper. She is represented by Eric Chaffin, Patrick Booth and Justin D. Joseph of Chaffin Luhana LLP in Pittsburgh, Pennsylvania. The case has been assigned to Circuit Judge Jason A. Cuomo.
