Cameron property owners allege concrete floor poured by Ohio company is defective

MOUNDSVILLE – The owners of a Cameron property allege that an Ohio company they hired to pour a concrete basement floor was negligent in its construction.

Christopher and Heather Hartley filed a complaint Feb. 16 in Marshall Circuit Court against Jerry Gust Masonry and Concrete Inc. alleging breach of contract.

According to the complaint, the plaintiffs allege that they contracted defendant to pour a basement floor at their Dry Ridge Road, Cameron property. They allege the floor is not level, that the floor has crushed piping underneath it and that the floor is defective.

The plaintiffs holds Jerry Gust Masonry and Concrete Inc. responsible because the defendants allegedly violated the common law principles by negligently constructing the concrete floor.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that will fully compensate them for their damages and and all further relief that the court deems just. They are represented by Teresa C. Toriseva and Joshua D. Miller of Toriseva Law in Wheeling. The case has been assigned to Circuit Judge Jeffrey Cramer.
