ELKINS – A Pittsburgh man alleges he was injured while riding his bicycle at a Roanoke property because of an unmarked speed bump.

Thomas F. O’Boyle filed a complaint Feb. 26 in U.S. District Court for the Northern District of West Virginia against Benchmark Conference Centers of West Virginia LLC, doing business as Stonewall Resort, alleging negligence.

According to the complaint, the plaintiff alleges that on July 10, 2017, he was a paying guest at defendant's Stonewall Resort. He alleges he was riding his specialized Roubaix bicycle on the property when he suddenly hit an unmarked and dangerous speed bump. He alleges he was thrown from his bike and violently skidded down the road, causing cuts, lacerations and bruises. He alleges he sought assistance at the defendant's lobby but no medical professionals were available or a first aid kit.

The plaintiff holds Benchmark Conference Centers of West Virginia LLC responsible because the defendant allegedly negligently installed a needless and dangerous speed bump on the property and failed to warn its guests, customers and/or business invitees of the dangerous condition.

The plaintiff requests a trial by jury and seeks compensatory and consequential damages, plus interest, attorneys’ fees and costs and any further relief as the court deems just and proper. He is represented by Paul M. Mannix of Marcus & Shapira LLP in Pittsburgh.
