Family members blame Charleston nursing home facility operators for woman's death

CHARLESTON — Family members are suing Charleston nursing home facility operators, alleging breach of duty and negligence in the death of a resident.

Lynn S. Eldridge and Jason D. Eldridge, as personal representatives of the estate of Trilbie L. Clukey, filed a complaint in Kanawha Circuit Court against Emeritus Corp. and Donna Prowse, alleging wrongful death. 

According to the complaint, on Nov. 30, 2016, decedent Trilbie Clukey was admitted at the defendants' Brookdale Charleston Gardens for rehabilitation and assistance with her daily living. As a result of the defendants' negligent acts, the suit says, Clukey suffered multiple falls, a rib fracture and a head injury that ultimately contributed to her death June 4, 2017. 

The plaintiffs allege the defendants failed to provide a safe environment, failed to provide adequate supervision and failed to provide for Clukey's basic needs.

The Eldridges seek trial by jury, compensatory and punitive damages, attorney fees, court costs and all further relief the court deems fit. They are represented by attorneys Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston.
