Wetzel County couple accuses local health care providers of malpractice

NEW MARTINSVILLE — A Wetzel County couple is suing local health care service providers, alleging professional malpractice.

Larry Young and Kristen Young filed a complaint Feb. 24 in Wetzel Circuit Court against Dr. Bill Michael Apostolon and ERx LLC, alleging the defendants negligently deviated from the standard of care by failing to timely diagnose and treat Larry Young's cancer.

According to the complaint, beginning in February 2017, Larry Young was a patient of the defendants. As a result of the defendants' negligent acts, the suit says, his risk of harm increased. 

The lawsuit states Young sustained temporary and permanent injuries, resulting in pain, mental anguish, deformities, medical expenses and embarrassment. The plaintiffs allege the defendants failed to send Young's surgically removed tissue for pathological analysis.

The Youngs seeks trial by jury, compensatory damages, plus interest, litigation costs and expenses and all other just relief. They are represented by attorneys William S. Druckman and Madonna C. Estep of Law Offices of Druckman & Estep in Charleston.
