FAYETTEVILLE — A borrower is suing a bank, alleging intentional infliction of emotional distress and invasion of privacy.
Daniel Lanham filed a complaint Feb. 26 in Fayette Circuit Court against Onemain Financial Inc., alleging the bank violated the West Virginia Credit and Protection Act and the Computer Crime and Abuse Act.
According to the complaint, after Lanham became in arrears upon his alleged debt with the bank, Onemain began communicating with him. As a result, Lanham says he was harassed, annoyed, inconvenienced, angered and emotionally distressed.
The plaintiff alleges Onemain Financial intentionally engaged in unreasonable and oppressive conduct by causing Lanham's phone to ring repeatedly or continuously at unusual times.
Lanham seeks trial by jury, all damages as allowed by law, litigation costs and all further relief the court deems proper. He is represented by attorneys Ralph C. Young, Christopher B. Frost and Steven R. Broadwater Jr. of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.
