Former inmate alleges correctional facility operators violated her constitutional rights

CHARLESTON — A former inmate is suing the operators of a Charleston correctional facility, alleging assault and battery.

A.M.J. of Kanawha County filed a complaint March 1 in Kanawha Circuit Court against Jesse A. McQuay, the West Virginia Department of Corrections and John Doe, alleging violation of the Eighth, Ninth and 14th Amendments to the U.S. Constitution.

According to the complaint, during A.M.J's incarceration at the defendants' Charleston Correctional Center from December 2015-April 2016 and from July-November 2017, she was repeatedly sexually assaulted, abused, harassed and manipulated by defendants. She says she has suffered severe emotional distress and other damages. 

The plaintiff alleges the defendants subjected her to unwanted sexual acts, lewd comments, unwanted molestation, digital penetration and oral sex.

A.M.J. seeks trial by jury, compensatory and punitive damages for loss of the ability to enjoy life, court costs, attorney fees and all further relief the court deems appropriate. She is represented by attorneys Troy N. Giatras and Phillip A. Childs of The Giatras Law Firm PLLC in Charleston.
