Former S&S Firestone worker alleges wrongful termination

HUNTINGTON — A Wayne County warehouse worker is suing his former employer, alleging retaliation and wrongful termination.

David Adkins filed a complaint March 2 in Cabell Circuit Court against S&S Firestone Inc., alleging violation of the West Virginia Human Rights Act.

According to the complaint, Adkins began working for S&S Firestone in 1996. The suit says on June 21, 2017, he was wrongfully terminated form his employment, approximately one year after a workplace injury and immediately after receiving workers' compensation benefits. 

Adkins says he has suffered lost wages and benefits, embarrassment, humiliation and emotional distress. The plaintiff alleges S & S Firestone subjected him to harassment, discriminatory actions and retaliated against him and terminated his employment for exercising his rights.

Adkins seeks trial by jury, compensatory, punitive and consequential damages, plus interest, litigation costs and all further relief the court deems just and equitable. He is represented by attorney James D. McQueen Jr. of McQueen Davis PLLC in Huntington.
