Logan Co. woman blames truck driver, owner for crash

LOGAN — A Logan County motorist is suing a truck driver and owner, alleging negligence caused a crash that injured the plaintiff.

Mildred Browning filed a complaint March 2 in Logan Circuit Court against Ricky Ray Clark II and Cecil I Walker Machinery Co., alleging Clark breached his duty to operate a commercial vehicle in a careful and prudent manner.

According to the complaint, on March 2, 2016, Browning was driving a motor vehicle northbound on U.S. Route 119 near Chapmanville when Clark negligently caused the International 4000 series truck owned by Cecil I Walker Machinery to crash into the plaintiff's vehicle. 

The suit says Browning sustained permanent injuries that resulted in medical expenses, physical and mental pain, loss of earning capacity, anxiety and aggravation. The plaintiff alleges Clark carelessly attempted an improper and unsafe passing and failed to give an audible signal.

Browning seeks trial by jury, judgment against the defendants, jointly and severally, for all damages she suffered and all further relief the court deems just and proper. She is represented by attorneys S. Brooks West II and Nathan J. Chill of West Law Firm LC in South Charleston.
