CHARLESTON — A Kanawha County man has filed a class action lawsuit against a debt collector, alleging violation of of state and federal law.
James Hudnall filed a complaint, individually and on behalf of all those similarly situated, March 7 in Kanawha Circuit Court against MasterCraft Home Solutions LLC alleging the defendant threatened the plaintiff with attorney fees in an attempt to collect an alleged debt.
According to the complaint, Hudnall was damaged financially due to MasterCraft's additional costs being pushed for the work to be completed for a bathroom on Hudnall's property in South Charleston. The suit says MasterCraft's actions caused Hudnall and his family to have to use a neighbor's bathroom for weeks when the project was not completed by the agreed-upon date in December 2016.
The plaintiff alleges MasterCraft Home Solutions failed to inform the plaintiff of the three-day right to cancel, attempted to collect attorney fees and was generally abusive in attempting to collect from Hudnall.
Hudnall seeks trial by jury, damages, statutory damages, compensatory damages, punitive damages, court costs and any further relief the court grants. He is represented by attorneys Troy N. Giatras and Phillip A. Childs of The Giatras Law Firm, PLLC in Charleston.
