Store manager accuses BP gas station of wrongful discharge

NEW CUMBERLAND — A store manager is suing her former employer and supervisor at a BP gas station in Wierton, alleging alleged retaliation and wrongful discharge.

Stacey DeBee of New Cumberland filed a complaint March 8 in Hancock Circuit Court against NILU Enterprise Inc., doing business as BP Gas Station, and Josephine Lamberti, alleging violation of state law.

According to the complaint, DeBee was discharged from her store manager position at the BP Gas Station, 341 Penco Road, Wierton, on Dec. 23, 2017, after she complained to Lamberti about another employee showing photos on her cellphone of child pornography. DeBee says as a result of defendants' outrageous conduct, she has suffered lost wages and employment benefits, severe emotional distress, anxiety, embarrassment and financial hardship. 

The suit says DeBee was terminated because the defendant retaliated against her for reporting a co-worker's illegal activity regarding child pornography.

DeBee seeks trial by jury, compensatory, punitive and exemplary damages, plus interest, attorney fees, court costs and all further relief the jury deems just. She is represented by attorneys Karl Kolenich and Erika Klei Kolenich of Klie Law Offices PLLC in Buckhannon.
