General contractor alleges Milton property owners owe $29,000

POINT PLEASANT — A general contractor is suing Milton property owners and a mortgagee, alleging breach of written agreement.

White and Associates LLC filed a complaint March 8 in Mason Circuit Court against Kerri Mondlak, Brian Mondlak and The Ohio Valley Bank Company, alleging they owe more than $29,000 for failing to perform their contractual obligations.

According to the complaint, on March 20, 2017, White and Associates agreed to construct the Mondlaks' new residence at 201 Buffington Acres, Milton, including all labor, materials, equipment and services for $268,842.94. As a result of the defendants' conduct, the suit says, the amount of $29,073.24 remains due and owing. 

The plaintiff alleges the Mondlaks took occupancy of the residence before completion, refused to allow White and Associates to complete its work and refused to pay the remaining balance.

White and Associates seeks trial by jury, an order authorizing sale of the property at an auction, damages of $29,073.24, plus interest, costs and expenses and any further relief the court deems proper. It is represented by attorney Mark A. Saad of Lewis Glasser PLLC in Charleston.
