BECKLEY — A Raleigh County man is suing a Glen Daniel construction business, alleging disability discrimination, retaliation and wrongful termination.
Nicholas Lee Pugh filed a complaint March 5 in Raleigh Circuit Court against BIT Construction LLC, alleging his former employer violated public policy.
According to the complaint, Pugh began working for BIT in July, and on Sept. 27, he received injuries to his right forearm and bilateral heel contusions while performing his job duties.
On the following day, the suit says, Pugh was terminated while he was under the care of a physician for a compensable injury.
Pugh says he has suffered lost income and employment benefits, emotional distress and loss of quality of life.
The plaintiff alleges BIT Construction wrongfully terminated his employment in retaliation for filing a workers' compensation claim.
Pugh seeks trial by jury monetary and punitive damages, reinstatement to his prior position, pre-judgment interest, attorney fees, court costs and all other just and proper relief.
