New Martinsville couple accuses chemical plant owner of negligence

MOUNDSVILLE — A New Martinsville couple is suing a chemical plant owner, alleging trespassing and private nuisance.

James Isaacs and Iris Isaacs filed a complaint March 13 in Marshall Circuit Court against Axiall Corporation, alleging failure to protect the surrounding Marshall County communities from the hazardous chemicals.

According to the complaint, on Aug. 27, 2016, a rail tanker inside Axiall's property in Proctor leaked a substantial amount of liquid chlorine, causing it to travel to plaintiffs' property in New Martinsville. As a result, the Isaacs couple says they have suffered property damages, personal injuries, annoyance, anxiety, medical expenses and attorney fees. 

The plaintiffs allege Axiall failed to exercise due care in managing and controlling hazardous chemicals by failing to contain the liquid chlorine in a safe manner.

James and Iris Isaacs seek a trial by jury, all damages, plus interest, litigation costs and expenses, and all further relief the court deems just and proper. They are represented by attorneys James G. Bordas and Jeremy M. McGraw of Moundsville.
