Motor vehicle owner alleges trucking service damaged car

MOUNDSVILLE — Marshall County motor vehicle owners are suing trucking services, alleging breach of an oral contract and negligence.

Ricky J. Beresford, doing business as Ricky's Rebuildables and R & R Auto, filed a complaint March 13 in Marshall Circuit Court against Dorado Logistics LLC and Buckeye Transport Group LLC, alleging they failed to provide trucking services in a good and workmanlike manner.

According to the complaint, on Nov. 28, 2017, Ricky's Rebuildables and R & R Auto entered into an oral contract with the defendants to deliver its newly purchased 2008 Chevrolet Silverado K1500 from Florida to its place of business in Cameron, West Virginia. As a result of the defendants' negligence, the suit says, the Silverado was severely damaged, resulting in costly repairs, loss of sale, loss of insurance premiums and annoyance. 

The plaintiffs allege Dorado Logistics and Buckeye Transport Group failed to deliver the vehicle free from damage and/or defects and in the same exact condition.

Ricky's Rebuildables and R & R Auto seek trial by jury, compensatory and general damages up to $75,000, plus interest, and all general and proper relief. They are represented by attorney Shane M. Mallett of Mallett Law Offices in Wheeling.
