MOUNDSVILLE — A Marshall County motorist is suing a truck owner and a Pennsylvania driver, alleging negligence caused a crash that injured the plaintiff.
Walter Bumgardner filed a complaint March 15 in Marshall Circuit Court against John J. McIntyre Jr. of Roaring Spring, Pennsylvania, and Tim Hockenberry Trucking Inc., alleging McIntyre failed to use reasonable care and caution for the safety of other motorists.
According to the complaint, on Nov. 11, 2016, Bumgardner was operating his motor vehicle on state Route 2. The suit says a truck driven by McIntyre and owned by Hockenberry negligently made a dangerous turn and crashed into Bumgardner's vehicle.
Bumgardner says he sustained severe personal injuries to various areas of his body, plus pain and discomfort, which lead to medical expenses involving surgical procedures.
The plaintiff alleges McIntyre failed to yield right of way, failed to maintain careful lookout and negligently attempted an improper and illegal turn and lane change.
Bumgardner seeks trial by jury, all damages, plus interest and taxable costs. He is represented by attorney Gail W. Kahle of Wheeling.
