WHEELING — A Valley Grove couple is suing an Ohio construction company, alleging breach of implied warranty.

Howard John Haglock and Stephanie Haglock filed a complaint March 21 in Ohio Circuit Court against Melanko Construction Co., alleging the defendant falsely represented it could perform work within the industry standard.

According to the complaint, as a result of the defendant's breaches, the Haglocks have suffered damages to personal and real property at 2374 McGraws Run Road, Valley Grove, diminution in value, annoyance, inconvenience and additional costs to repair the defective work.

The suit says the work included replacing a storage shed, cleaning the duct work, replacing a living room banister, repairing dry wall holes and family room cracks, plus work on the patio and in the garage.

The plaintiffs allege Melanko Construction failed to complete the work as contracted in a good and workmanlike manner.

The Haglocks seek trial by jury, compensatory and consequential damages, plus interest, attorney fees, court costs and all further relief the court deems just and proper. They are represented by attorney Andrea C. Poling of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.
