Customer alleges Lowe's negligence caused her to trip on steel platform

BECKLEY — A Raleigh County woman is suing Lowe's, alleging negligence led to injuries for the plaintiff.

Mary Ann Lilly filed a complaint March 21 in Raleigh Circuit Court against Lowe's of West Virginia Inc,. alleging the home improvement company failed to provide a safe and hazard-free environment.

According to the complaint, on March 24, 2016, Lilly was shopping at the Lowe's in the Cranberry Creek Shopping Center in Beckley. The suit says Lilly tripped on a steel platform cart and sustained injuries to her leg, rotator cuff, arm, knee and ankle. 

The plaintiff alleges Lowe's of West Virginia negligently allowed the heavy-duty steel platform cart to remain unattended in the walkway and failed to provide a warning of the hazardous condition.

Lilly seeks trial by jury, compensatory, general and punitive damages, plus interest, court costs, attorney fees and all further proper and just relief. She is represented by attorney Robert P. Dunlap II of Dunlap & Associates in Beckley.
