LOGAN — An Atlanta medical equipment company is suing a Stollings medical supplier, alleging failure to pay more than $2,500 for goods ordered and unjust enrichment.
Philips Respironics filed a complaint March 16 in Logan Circuit Court against K-A Medical Services Inc., alleging failure to perform its contractual obligations.
According to the complaint, Phillips sold certain goods to K-A Medical Services on credit. The suit says after allowance for all credits for payments and returned merchandise, the amount of $2,576.93 remains due and unpaid.
The plaintiff alleges K-A Medical Services has failed and refuses to make payments for the said amount and wrongfully retained the benefits of the goods without paying.
Philips Respironics seeks judgment of $2,576.93, plus continually accruing interest, costs of suit and all other relief. It is represented by attorney John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
