Preston Co. man accuses truck dealers of fraudulent withholding

KINGWOOD — A Preston County man is suing truck dealers, alleging fraudulent withholding.

Victor B. Trimble Sr. filed a complaint March 22 in Preston Circuit Court against the estate of Eric Larew, Rhonda Larew, BB&T Trucking and Larew's Used Cars LLC, alleging violation of the West Virginia Code.

According to the complaint, in September 2017, Trimble made the final payment for the 2001 Peterbilt truck he bought from defendants in November 2014. The suit says Trimble requested the execution and issue of a release to be filed with the West Virginia Department of Motor Vehicles to clear the title. 

The lawsuit states that Larew died Oct. 22, 2017, and his wife, Rhonda Larew, demanded that Trimble pay her $25,000 for the Peterbuilt truck. Trimble says he already had satisfied all truck payments.

The plaintiff alleges despite having satisfied the debt, the defendants have failed to file the release of the lien to clear the title of the vehicle.

Trimble seeks trial by jury, an order for the defendants to release the lien on the Peterbilt truck and return the title to the plaintiff, all damages, plus interest and all further relief the court deems just and equitable.
