Kentucky business alleges insurer failed to pay benefits

MOUNDSVILLE — An insured Kentucky business is suing a liability insurer, alleging breach of an insurance contract and breach of duty.

A&R Logistics of Louisville filed a complaint April 4 in Marshall Circuit Court against Zurich American Insurance Company, alleging failure to provide proper coverage. 

According to the complaint, Zurich American Insurance breached its contractual obligations by denying coverage and defense for the claim asserted against A&R Logistics employee Christopher Toth. 

As a result of the defendant's actions, A&R says it was damaged for having to retain its own counsel to represent its interest in a claim asserted against its employee and in obtaining coverage against the defendant..

A&R Logistics seeks trial by jury, compensatory and punitive damages, plus interest, costs, attorney fees and any further relief the court deems just and proper.
