CHARLESTON — A securities representative is suing Morgan Stanley and a human resources director, alleging breach of statutory duties.
Benjamin Burton of Putnam County filed a complaint in Kanawha Circuit Court against Morgan Stanley Smith Barney LLC and Amy Nash, alleging they violated the West Virginia Wage Payment and Collections Act.
According to the complaint, on Oct. 28, 2016, Burton, who had worked at Morgan Stanley for four years, was unlawfully terminated from his employment for objecting to sell a product that constituted predatory lending. The suit says this caused Burton to suffer lost wages and benefits, indignity, embarrassment and humiliation.
The plaintiff alleges Morgan Stanley and Nash failed to pay the salary bonus of $100,000 after Burton obtained $1 million in gross revenue and then terminated his employment for disagreeing to alter his status based on his bonus program.
Burton seeks trial by jury, compensatory, punitive and liquidated damages, plus interest, litigation costs and all further relief the court deems just and equitable. He is represented by Travis A. Griffith of Griffith Law Center PLLC in Charleston.
