NAPA Auto Parts alleges debtor, guarantor owe more than $14,000

CHARLESTON — NAPA Auto Parts is suing a debtor and guarantor, alleging breach of contract and unjust enrichment.

NAPA Auto Parts filed a complaint in Kanawha Circuit Court against Joyce's Auto Detail and Auto Repair Servicing LLC and Joyce Bucalew, alleging they owe more than $14,000 failure to perform their contractual obligations.

According to the complaint, beginning in 2015 and upon the defendants' request, NAPA sold certain goods to the defendants on credit. After allowance for all proper credits for payments and/or returned merchandise, the suit says, the amount of $11,626.05 remains due and owing. 

The plaintiff alleges Joyce's Auto Detail and Auto Repair Servicing LLC and Joyce Bucalew responsible because despite demand for payment, the defendants allegedly failed and refused to pay the said amount.

The plaintiff seeks trial by jury, judgment of $11,626.05, plus accruing interest from April 30, 2017, attorney fees of $2,780, court costs and all further just relief. NAPA is represented by attorney John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
