St. Albans couple alleges improper foreclosure

CHARLESTON — A St. Albans couple is suing a mortgage loan servicer and holder, alleging illegal and abusive loan servicing.

Lisa Miley and Todd Miley filed a complaint in Kanawha Circuit Court against Carrington Mortgage Services LLC and Deutsche Bank National Company as trustee for the Carrington mortgage loan trust series et al, alleging assessment of illegal fees. 

According to the complaint, as a result of the defendants unlawful conduct, the Miles have suffered anxiety, annoyance, stress, worry, inconvenience and fear of losing their home at 24 Willis Lane, St. Albans. 

The plaintiffs allege the defendants repeatedly assessed illegal fees, refused to accept payments and pursued foreclosure of their St. Albans home without providing notice of their right to cure.

The Mileys seek trial by jury, actual and punitive damages, attorney fees, court costs and all other relief the court deems just and equitable. They are represented by attorneys Sarah K. Brown, Bren J. Pomponio and Daniel F. Hedges of Mountain State Justice Inc. in Charleston.
