CHARLESTON — A Minnesota medical products distributor is suing a Charleston medical retail store, alleging failure to pay more than $130,000 for ordered goods.
McKesson Medical-Surgical Minnesota Supply Inc. filed a complaint in Kanawha Circuit Court against Boll Medical Inc., alleging failure to perform its contractual obligations.
According to the complaint, between July 14- Nov. 30 2017, McKesson provided goods to Boll Medical on credit. After allowance for all proper credits for payments and/or returned merchandise, the suit says, the amount of $130,518.76 remains payable.
The plaintiff alleges Boll Medical, despite repeated demands for payment, has refused to pay the said amount or any part of it.
McKesson Medical-Surgical Minnesota Supply seeks trial by jury, judgment for $130,518.76, plus $7,178.53 in attorney fees, accruing interest of 7 percent per annun and all further just relief. It is represented by attorney John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
