Worker alleges South Charleston business' negligence led to injuries

CHARLESTON — A St. Albans man is suing a South Charleston business, alleging negligence led to injuries for the plaintiff.

Roger L. McCauley filed a complaint in Kanawha Circuit Court against Gestamp West Virginia Inc., alleging failure to provide a safe place to work.

According to the complaint, on March 31, 2016, McCauley was assigned to work at Gestamp's place of business, 3100 MacCorkle Ave., SW Building No. 307, South Charleston. While working on a machine, the suit says, the bar of the apparatus suddenly let go, causing McCauley to be thrown backward into a steel rack. 

McCauley says he has suffered severe and permanent injuries and great mental anguish and incurred medical expenses. The plaintiff alleges Gestamp West Virginia failed to provide safe tools and equipment to perform his work and failed to properly instruct and supervise McCauley about his duties.

McCauley seeks trial by jury, compensatory damages, plus interest, court costs and all further relief the court deems proper. He is represented by attorney Shannon M. Bland of Bland & Bland in Charleston.
