Morgantown woman accuses Gabe's, former co-worker of sexual harassment

MORGANTOWN — A Morgantown woman is suing her former employer and a co-worker, alleging sexual harassment discrimination and constructive termination.

Angel Dawn Cox filed a complaint April 12 in Monongalia Circuit Court against Gabriel Brothers Inc., also known as Gabe's, and Scott Kerns, alleging they violated the West Virginia Human Rights Act.

According to the complaint, Cox began work for Gabe's as a pricer in August 2016 before being promoted to material handler in November 2016, always performing her work in a satisfactory manner. Cox says on April 19, 2017, she was forced to quit her job due to a hostile work environment that was not being addressed, including Kerns' racist and sexual remarks. 

The suit says Cox has suffered financial hardship, emotional distress, anxiety and embarrassment. The plaintiff alleges the defendants failed to take corrective actions to her complaint of harassment and constructively terminated her employment by subjecting her to disparate treatment and a hostile work environment because she was pregnant.

Cox seeks trial by jury, compensatory and punitive damages, attorney fees, court costs and all further relief the court deems just. She is represented by attorney Erika Klie Kolenich of Klie Law Offices PLLC in Buckhannon.
