CHARLESTON — An estate administrator is suing asbestos products manufacturers, alleging failure to warn and negligence in causing the death of a relative.
Deborah Adkins, administrator of the estate of Chester Lee Adkins, filed a complaint in Kanawha Circuit Court against 84 Lumber Company, Borg-Warner Corp., Ingersol-Rand, et al, alleging failure to exercise reasonable care and caution for the safety of others.
According to the complaint, as a result of Chester Lee Adkins' exposure to asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants, he developed lung cancer, an asbestos-induced disease. He died April 4, 2016.
The plaintiff alleges the defendants negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
Deborah Adkins seeks trial by jury, compensatory damages to be determined at trial, costs of court, interest and all further relief the court deems just. She is represented by attorney Michael J.
