Estate administrator alleges Transamerica failed to pay death benefits

BECKLEY — A Raleigh County woman is suing a licensed insurer, alleging breach of an insurance contract.

Janae Abner of Beckley, individually and as administrator of the estate of Brenda Joyce McKinney, filed a complaint April 16 in Raleigh Circuit Court against Transamerica Premier Life Insurance Company, alleging failure to pay death benefits. 

According to the complaint, upon the passing of Brenda Joyce McKinney in 2017, Abner timely submitted a claim for benefits under the insurance policy issued by Transamerica but was unsuccessful. 

The plaintiff alleges despite Abner submitting all requested documents, Transamerica Premier Life Insurance has failed and refuses to pay the benefits due to her.

Abner seeks trial by jury and compensatory and statutory damages up to $75,000. She is represented by attorney Greg A. Hewitt of Hewitt & Salvatore PLLC in Fayetteville.
