Passenger alleges 2 motor vehicle drivers caused crash

CHARLESTON — A Kanawha County woman is suing two motor vehicle drivers and an owner, alleging their negligence caused a crash that injured the plaintiff.

Jacqueline Michelle Banks filed a complaint April 20 in Kanawha Circuit Court against Jane Doe, individually and as an employee of Champion Industries Inc., and James Pannell, alleging Doe and Pannell breached their duties to operate their respective vehicles with due care and caution.

According to the complaint, on April 22, 2016, Banks was a passenger in a motor vehicle driven by Pannell traveling on Washington Street in Charleston. The suit says Doe, an employee of Champion, slammed into Parnell's vehicle, driving into the passenger side of the vehicle where Banks was riding. 

Banks says she sustained injuries that resulted in pain and suffering, medical expenses, annoyance and inconvenience. The plaintiff alleges Doe and Pannell failed to maintain proper control of their respective vehicles.

Banks seeks trial by jury, judgment up to $75,000 and all further relief the court deems just. She is represented by attorney Michael Del Giudice of Ciccarello, Del Giudice LaFon in Charleston.
