Cabell Co. woman alleges Big Lots' negligence led to injuries

HUNTINGTON — A Cabell County woman is suing a Charleston retail store operator, alleging insufficient measures were taken to prevent injuries.

Virginia Scott filed a complaint in Cabell Circuit Court against Big Lots Stores Inc., alleging failure to maintain its store premises reasonably safe for its customers.

According to the complaint, on March 4, 2017, Scott was shopping at Big Lots Stores near 14th Street and Madison Avenue in Charleston. The suit says items of merchandise that were on display then fell on her, leading to bodily injuries that required medical treatment. 

The plaintiff alleges a Big Lots Stores employee failed to exercise reasonable care when displaying retail merchandise for sale and the store failed to warn customers of any known hazards.

Scott seeks trial by jury, damages in excess of the minimum jurisdictional limits of the court, plus interest, court costs, attorney fees and all further appropriate relief. She is represented by attorney Neil R. Bouchillon of Bouchillon, Crossan & Colburn LC in Huntington.
