MOUNDSVILLE — A Marshall County couple is suing Shawn McCamick, doing business as T&M Electric and Construction, alleging breach of contract.
John E. Riggs Jr. and Dalena Riggs filed a complaint April 25 in Marshall Circuit Court against the defendant alleging that he failed to install an agreed-upon HVAC system.
According to the complaint, the plaintiffs allege that the parties entered into an agreement, in which the defendant would install a specific HVAC system for the plaintiffs. However, he allegedly delivered a non-conforming HVAC system to their property. As a result of defendant's breach, the plaintiff had to seek another contractor and suffered through the winter months without heat. The plaintiffs hold McCamick responsible because he allegedly failed to complete the contracted work in a timely manner and refused to return a $5,500 deposit.
The plaintiffs request a trial by jury; and seek damages in an amount that the jury may award, plus interest and all further relief as the court may deem appropriate. They are represented by David C. White of the Law Offices of Neiswonger and White in Moundsville.
