State Farm accused of failing to pay couple's uninsured motorist claim

MOUNDSVILLE — An Ohio couple is suing State Farm Mutual Automobile Insurance Company, alleging breach of contract.

Lisa Kirchner and Timothy Kirchner filed a complaint April 27 in Marshall Circuit Court against State Farm, alleging that the insurer failed to perform its contractual obligations.

According to the complaint, the plaintiffs allege that on April 28, 2015, Lisa Kirchner was injured in a motor vehicle accident due to the carelessness of an uninsured driver. She allegedly sustained injuries, damages and losses for which the couple attempted to negotiate a settlement of the uninsured claim with the defendant. The plaintiffs hold State Fram responsible because the defendant allegedly failed to settle their claim for uninsured motorist coverage.

The plaintiffs request a trial by jury; and seek payment for the entire insurance contract, compensatory damages, plus interest, attorney's fees, costs and any further relief as the court sees fit to award. They are represented by Jacob M. Robinson and David P. Robinson of Robinson Law Offices in Wheeling.
