Dialysis technician claims Total Renal Care fired her because of pregnancy

CHARLESTON — A dialysis technician is suing former employer Total Renal Care Inc. for discrimination, retaliation and wrongful termination.

Whitney Monk filed a complaint April 30 in Kanawha Circuit Court, alleging that Total Renal Care violated the West Virginia Human Rights Act when she was terminated from her employment in April 2017, despite exceeding defendant's legitimate expectations.

Since being fired by the defendant, Monk said she had been unable to find suitable gainful employment and has suffered loss of income, humiliation, emotional distress, annoyance and damage to her reputation.

The plaintiff claimed that Total Renal Care failed to provide reasonable accommodation and terminated her in retaliation for becoming pregnant and requiring related reasonable accommodations.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, pre-judgment and post-judgment interest, attorney's fees, costs and other fair and proper relief. She is represented by Hoyt Glazer of Law Office of Hoyt Glazer PLLC in Huntington.
