Marshall County customers accuse kitchen, flooring company of deceptive practices

MOUNDSVILLE — A Marshall County couple is suing a flooring and kitchen product and services company and its owner, alleging breach of contract, breach of duty, and breach of implied warranty.

Karah Sambuco and Mark Sambuco filed a complaint in Marshall Circuit Court against Herr LLC, doing business as Dlesk Kitchens & Flooring, and Kelly Lyn Dlesk, alleging they used unfair methods of competition and unfair or deceptive acts or practices.

According to the complaint, between on June 1, 2017, Karah Sambuco was solicited to enter into a contract with Randall J. Dlesk of Dlesk Kitchens & Flooring for work in plaintiffs' kitchen at 559 Wood Hill Lane, Moundsville. The suit says the work should have been completed by Aug. 1, 2017, but wans ended instead Sept. 7, 2017. 

Moreso, lawsuit states the service quality does not meet the reasonable standard including an incomplete installation of the items ordered. 

The suit says the Sambucos have had to seek bids from other carpentry and cabinet companies to do the work properly.

The plaintiffs allege the defendants hired/authorized employees and independent contractors/subcontractors who violated duties of candor, truthfulness and quality workmanship. In addition, the suit says, misrepresentations and omissions were made with regard to the information on the project contract.

The Sambucos seek trial by jury, compensatory damages, punitive damages, attorney fees, litigation expenses, interests and costs. They are represented by attorney Ronald W. Kasserman of Kasserman Law Offices in Wheeling.
