Former Shield Roofing and Construction sales rep alleges he was not paid all commissions

CHARLESTON – A former sales representative for a Kanawha County business alleges he is owed unpaid commissions.

John M. Lee filed a complaint in Kanawha Circuit Court against Shield Roofing and Construction LLC and Jose Cabrales alleging that they violated the West Virginia Wage Payment and Collection Act.

According to the complaint, the plaintiff alleges that he worked for defendant until November 2016. He alleges the defendants agreed to pay him commission based upon his sales, but the defendants have failed to pay all the commissions he earned.

The plaintiff holds Shield Roofing and Construction LLC and Cabrales responsible because the defendants allegedly failed to pay all commissions that he earned prior to his separation.

The plaintiff requests a trial by jury and seeks all remedies available under the law, pre- and post-judgment interest, attorney's fees and costs and all issues triable by jury. He is represented by Todd S. Bailess and Michael P. Addair of Bailess Smith PLLC in Charleston.
