Law firm alleges construction business 10 years late with payment

BECKLEY — A Fayetteville attorney and law firm are suing a Raleigh County contractor and construction company, alleging breach of contract.

Thomas Fast and Fast Law LC filed a complaint in Raleigh Circuit Court against Jack Williams and A and E Construction Co. Inc., alleging refusal to pay nearly $122,000 in spite of the repeated requests nearly10 years after the litigation ended.

According to the complaint, on July 14, 2008, Fast and Fast Law entered into a contract with Williams to represent him in a civil litigation, Clearwater Construction, LLC et al v. A and E Construction Co. Inc. et al.

The suit says Fast Law provided legal services until the litigation concluded. The contract allegedly states the defendants agreed to a legal fee of 17.5 percent of the value of any debt forgiveness received as a form of compromise, voluntary settlement or by final judgment as result of trial. 

Fast Law says it not yet received payment of $121,928.91. 

The plaintiffs allege Williams and A and E Construction signed a valid and enforceable agreement that has existed since July 14, 2008, and have breached it by failing to pay the indebtedness of $121,928.91.

Fast and Fast Law seek trial by jury, compensatory damages, reasonable costs, attorney fees, pre-judgment and post-judgment interests and all other just and proper relief. They are represented by attorney Stephen P. New of Beckley.
