Wardensville doctor alleges another physician owes $140,000

WHEELING — A dermatologist is suing another doctor, alleging breach of contract.

Dr. J. Robert West, doing business as West Dermatology and Las Vegas Skin & Cancer Clinics, filed a complaint in Ohio Circuit Court against Dr. Jerry Hahn, alleging failure to fulfill a required payment, which resulted in a $140,000 balance owed the plaintiff.

According to the complaint, between July 24, 2013 and May 18, 2018, West Dermatology and Las Vegas Skin & Cancer Clinics agreed that Hahn would sell all of the plaintiffs' assets of its Wheeling practice under their asset purchase agreement. The suit says Hahn agreed to pay $360,000 in 12 monthly installments of $30,000, to be fully paid no later than Aug.1, 2014, but he has failed to do so.

The suit says Hahn continued with his periodic payments until November 2015. West demanded the outstanding balance of $140,000 from Hahn in two separate letters. West says the latest latest letter was May 2018 but no response has been received from the defendant. 

The plaintiff alleges Hahn is legally bound by the asset purchase agreement, a valid and binding contract enforcing Hahn to perform his obligations.

West Dermatology and Las Vegas Skin & Cancer Clinics seeks trial by jury, damages of $140,000, attorney fees, costs, pre- and post-judgment interests and all further just and proper relief. West is represented by attorney John J. Richardson of Bernstein-Burkley PC in Pittsburgh.
