Inmate accuses West Virginia corrections operators of rape

HUNTINGTON — A former inmate is suing West Virginia correctional operators, alleging violation of her civil rights.

M.A. filed a complaint in Cabell Circuit Court against the West Virginia Regional Jail and Correctional Facility Authority, Timothy King, Carl Westfall, et al, alleging they violated her rights to be free from cruel and unusual punishments.

According to the complaint, on June 22, 2016, M.A. was sexually assaulted and raped by Westfall while she was incarcerated at WVRJCFA. She says she has suffered and will continue to suffer psychological harm, mental distress, humiliation and damage to her reputation. 

The plaintiff alleges the defendants refused to intervene and/or otherwise take actions to prevent Westfall from raping her and failed to provide clothing and meals.

M.A. seeks trial by jury, compensatory and punitive damages, plus interest, attorney fees, court costs and all other just relief. She is represented by attorney Hoyt Glazer of Law Office of Hoyt Glazer PLLC in Huntington.
