CHARLESTON — A husband and wife are suing Dennison Land & Development LLC, a real estate developer, citing alleged negligence, breach of contract, and violation of express and implied warranties.
Gregory M. Brewer and Susan Brewer filed a complaint in Kanawha Circuit Court against Dennison Land & Development LLC, alleging that the real estate developer negligently constructed their property.
According to the complaint, the plaintiffs allege that, on June 21, 2010, Gregory M. Brewer and Susan Brewer purchased a lot from the defendant for home building.
After the purchase and construction, plaintiffs discovered issues with the house such as but not limited to mold, improper drainage and water damage.
The plaintiffs hold Dennison Land Development LLC responsible because the defendant allegedly provided services and material that did not conform to the express and implied warranty of the contract, and did not meet the terms of the contract.
The plaintiffs request a trial by jury and seek consequential and incidental damages in an amount to be determined at trial and other damages and relief the court may find just and proper plus pre-judgment and post-judgment interests.
