Former employee accuses Kanawha County company of unlawful termination

CHARLESTON — A former employee is suing a Kanawah County company and and supervisor, alleging disability discrimination, retaliation and wrongful termination.

Tracey N. Poore filed a complaint in Kanawha Circuit Court against CDI Corporation, Billy Porter and Amy Deal, alleging violation of the West Virginia Human Rights Act.

According to the complaint, despite performing her duties in a satisfactory manner, Poore, who suffers from anxiety and post traumatic stress disorder, was terminated July 9, 2016 while she was on leave. The suit says Poore has suffered economic damages for lost wages and benefits, annoyance, inconvenience, emotional distress and loss of dignity. 

The plaintiff alleges CDI, Porter and Deal failed to provide reasonable accommodation and discriminated against Poore and terminated her due to her medical condition.

Poore seeks trial by jury, compensatory and punitive damages, litigation costs and expenses, and all other legal and equitable relief. She is represented by attorneys Rodney A. Smith and Jeffrey A. Foster of Bailess Smith PLLC in Charleston.
