Parents allege Charleston YWCA failed to follow daughter's emergency treatment plan

CHARLESTON — Kanawha County parents are suing a Charleston YWCA child daycare center, alleging personal injury involving their daughter.

Hollis and Elisha Lewis, on behalf of Kaizen Lewis (minor), filed a complaint in Kanawha Circuit Court against Young Women's Children Association of Charleston Inc., doing business as Mel Wolf YWCA Child Development Center, alleging it neglected to follow the emergency medical treatment plan for the minor plaintiff.

According to the complaint, on Sept. 28, 2017, Kaizen Lewis was in the care of the defendant when she suffered from an allergic reaction to peanut exposure. The plaintiffs allege Mel Wolf YWCA Child Development Center had been made aware of Kaizen's allergy when she enrolled there but the defendant failed to follow the treatment plan advised by Kaizen's allergists. The suit says the defendant also failed to adhere to the West Virginia Department of Health and Human Resource Child Care Center licensing guidelines.

The Lewises seek trial by jury, judgment to be determined by the jury, plus attorney fees, court cost and pre- and post-judgment interests. They are represented by attorney Brendan Doneghy of Charleston.
